A Constituição Europeia

O britânico Samizdata atira-se com unhas e dentes à análise da proposta da Constituição Europeia (CE). Promete ser o primeiro de vários artigos...

Não pretendo enveredar num trabalho tão herculeo mas queria focar o artigo I-3 - Objectivos da União:

2 The Union shall offer its citizens an area of freedom, security and justice without internal frontiers, and a single market where competition is free and undistorted.

Um nobre objectivo. No entanto, gostaria de saber, como as sumidades presentes na Covenção coadunam o principio da competição livre e sem distorção com políticas europeias como a PAC?

3 The Union shall work for a Europe of sustainable development based on balanced economic growth, with a social market economy aiming at full employment and social progress. (...)

Não sei se notaram mas o ponto 3 contradiz o ponto 2. Propõe uma economia planificada e promove essa falácia chamada "desenvolvimento sustentado".

A clausula do direito de secessão mantem o carácter político da decisão final (inclusivé com maioria qualificada)

Article I-59: Voluntary withdrawal from the Union
1 Any Member State may decide to withdraw from the European Union in accordance with its own constitutional requirements.

2 A Member State which decides to withdraw shall notify the European Council of its intention; the European Council shall examine that notification.

In the light of the guidelines provided by the European Council, the Union shall negotiate and conclude an agreement with that State, setting out the arrangements for its withdrawal, taking account of the framework for its future relationship with the Union.

That agreement shall be concluded on behalf of the Union by the Council, acting by a qualified majority, after obtaining the consent of the European Parliament
